Summary
In 2019, the Superior Court of Justice of Brazil granted the provisional protection of a parrot based on the violation of the ecological dimension of the principle of human dignity. The court recognized that non-recognition of non-human interests creates limits to the fundamental rights of human beings. “This vision of nature as an expression of life in its entirety makes it possible for constitutional law and other areas of law to recognize the environment and encourage humans as beings of their own value, deserving, therefore, respect and care, so that we can legal order attributes of ownership of rights and dignity,” the court said.
