Summary

An environmental activist submitted a request for precautionary measures against the Internal Revenue Service for the embargo of the Hacienda La Clementina located in the Parroquia La Unión in the province of Los Ríos—claiming the IRS’ actions would violate the rights of Nature and the Samama Protected Forest. The court decided that the Internal Revenue Service would violate the rights of nature if it were to auction off the property without defining specific mechanisms to guarantee the environmental protection of the Samama Protected Forest under new ownership of the Hacienda (3-4). In light of the threat of violations of the rights of the Samama Protected Forest, the judge ordered the Ministry of the Environment to oversee the civil action and adjudication process of Hacienda La Clementina to guarantee rights of nature and the Samama Protective Forest.
