Summary
In 2019, a precautionary measure was presented to the Constitutional Court of Ecuador requesting protection of the rights of nature threatened by the inevitable collapse of the dams planned to contain more than 390 million cubic meters of tailings in a mining project called the Mirador Copper Mine Project. The project’s activity constitutes an act that seriously and imminently threatens to violate the rights of nature in the upper Amazon river basin, the plaintiffs claimed. Arguing the principles of prevention and precaution, they request the immediate suspension of the construction of two tailings dams. The request was denied because the court said there was no imminent danger.
